Depends how you interpret evidence. My late father was an attorney, amongst other things.
1. The empty folders could have been empty when he took them. He might just have taken them for decor and to impress others.
2. He said he declassified them. We all think he is stupid. Maybe he genuinely believed that if he declassified them, then they were declassified. After all, there is a generally view that Trump thinks the president has divine rights.
My point was that, in relationship to getting found guilty and being jailed, a good attorney could get him off the hook.
There is no definite evidence. There is circumstancial evidence. There is a difference.
